Auditoría DRC
Auditoría independiente de cumplimiento de la Ley N° 20.930 para derechos reales de conservación, con criterios basados en estándares de la UICN y del Convenio sobre la Diversidad Biológica.
Realizada por la Fundación Centro de Derecho de Conservación (CDDC), en alianza con UB Conservación de Ubilla y Cía.
¿Qué verifica la Auditoría DRC?
1. Validez legal
Que el derecho real de conservación está bien constituido conforme a la Ley N° 20.930: escritura pública, inscripción en el Conservador de Bienes Raíces, objeto de conservación definido y titular habilitado.
2. Estándares UICN
Que los objetivos, el plan de manejo y el monitoreo siguen criterios basados en guías y estándares de buenas prácticas de la UICN para la conservación y las soluciones basadas en la naturaleza.
3. Convenio sobre la Diversidad Biológica
Que la gestión es coherente con el enfoque por ecosistemas del Convenio sobre la Diversidad Biológica (CDB) y aporta a sus metas de conservación.
Independencia. La Auditoría DRC es externa: el CDDC nunca es titular de los derechos reales de conservación que certifica, y los evaluadores no pueden tener conflicto de interés con el titular ni con quien asesoró la constitución del derecho. Quien audita no puede ser titular de lo que audita.
¿La Auditoría DRC reemplaza a un “custodio” o “garante”?
Sí. La Ley N° 20.930 no contempla custodios ni garantes: establece un titular del derecho real de conservación, que puede ser el propio dueño o una entidad de su confianza. La función de verificación que algunos atribuyen a un “custodio” o “garante” se cumple con una auditoría externa independiente, como la Auditoría DRC, sin entregar a un tercero la titularidad del derecho ni del patrimonio ambiental.

¿Cómo se obtiene?
- Solicitud del titular o del propietario, con la escritura e inscripción del DRC.
- Revisión legal de la constitución del derecho conforme a la Ley N° 20.930.
- Revisión técnica del objeto de conservación, el plan de manejo y el monitoreo.
- Informe de evaluación con observaciones y, si corresponde, medidas de ajuste.
- Informe y certificado con número de registro y vigencia, renovable mediante auditorías periódicas.
Uso del certificado
El titular puede usar el certificado de la Auditoría DRC (sello DRC Cumple) en su sitio web, documentos y comunicaciones mientras esté vigente. Cada certificado tiene un número de registro que permite verificar su validez con el CDDC.
La Auditoría DRC es realizada por la Fundación Centro de Derecho de Conservación. No es realizada ni avalada por la UICN ni por la Secretaría del Convenio sobre la Diversidad Biológica; certifica la conformidad con criterios basados en sus estándares y directrices.

DRC Audit
Independent audit of compliance with Chilean Law No. 20.930 for conservation rights, with criteria based on IUCN standards and the Convention on Biological Diversity.

What does the DRC Audit verify?
1. Legal validity
That the conservation right is properly established under Law No. 20.930: public deed, registration with the Real Estate Registrar, a defined conservation object and an eligible holder.
2. IUCN standards
That objectives, management plan and monitoring follow criteria based on IUCN guidance and good-practice standards for conservation and nature-based solutions.
3. Convention on Biological Diversity
That management is consistent with the ecosystem approach of the Convention on Biological Diversity (CBD) and contributes to its conservation goals.
Independence. The DRC Audit is external: the CDDC is never the holder of the conservation rights it certifies, and assessors may have no conflict of interest with the holder or with whoever advised on establishing the right. An auditor cannot hold what it audits.
Does the DRC Audit replace a “custodian” or “guarantor”?
Yes. Chilean Law No. 20.930 does not provide for custodians or guarantors: it establishes a holder of the conservation right, who may be the landowner or an entity they trust. The verification role some attribute to a “custodian” or “guarantor” is fulfilled by an independent external audit, such as the DRC Audit, without handing the right or the environmental assets to a third party.

How to obtain it
- Application by the holder or landowner, with the DRC deed and registration.
- Legal review of how the right was established under Law No. 20.930.
- Technical review of the conservation object, management plan and monitoring.
- Assessment report with findings and, where needed, corrective measures.
- Report and certificate issued with a registration number and validity period, renewable through periodic audits.
Use of the certificate
The holder may display the DRC Audit certificate (DRC Compliant seal) on its website, documents and communications while it is valid. Each certificate has a registration number that can be verified with the CDDC.
The DRC Audit is carried out by the Conservation Law Center Foundation. It is not carried out or endorsed by IUCN or by the Secretariat of the Convention on Biological Diversity; it certifies conformity with criteria based on their standards and guidance.
